The services described on this website and set forth at https://expungementnashville.com/services/ represent attorney advertising material from attorney Daniel A. Horwitz (“Attorney”).  Reviewing this website does not establish an attorney-client relationship.   Attorney does not and cannot guarantee that any evaluation will result in a finding of expungement eligibility.

No evaluation will be completed, and no attorney-client relationship shall be established, unless and until required payment has been received in full.  If expungement assistance is requested, no expungement petition will be filed, and no attorney-client relationship shall be established, unless and until required payment has been received in full.  Attorney’s completion of requested services shall terminate the attorney-client relationship.

Attorney will endeavor to complete requested expungement evaluations and transmit them via email within three business days of payment being received in full.  All purchases are final; however, Attorney reserves the right to decline any requested representation for any reason and to refund purchases in full.  The expungement eligibility evaluations advertised through this website apply only to charges originating in Davidson County, Tennessee.  Refunds will not be provided if an expungement is denied because a client or prospective client provided Attorney inaccurate information; because Attorney’s evaluation resulted in a finding of ineligibility; or because a client or prospective client lacks criminal history in Davidson County, Tennessee.

Persons purchasing expungement services agree and understand that an otherwise eligible charge cannot be expunged unless and until all outstanding court costs, fees, and fines, if any, have been paid in full.  Persons purchasing expungement services further understand that information regarding outstanding court costs, fees, and fines, if any, reflect estimates only based on the best information immediately available from the Davidson County Criminal Court Clerk’s website, and that such information may ultimately turn out to be inaccurate, particularly for older cases.  In the event that the actual amount of outstanding court costs, fees, and fines, if any, ends up being higher or lower than the amount indicated on the Davidson County Criminal Court Clerk’s website, both Attorney and Client agree that if Attorney is asked to pay off outstanding court costs, fees, and fines as part of the Client’s representation, in the interest of: (1) maintaining the certainty of a flat fee, (2) adhering to Attorney’s initial estimate(s), and (3) ensuring that an expungement petition is filed and processed as quickly as possible, Attorney’s initial estimate shall be the amount due.  As further consideration, Attorney agrees to bear exclusively the full expense of all credit card processing costs to the Davidson County Criminal Court Clerk in all cases in which Attorney is asked to pay off outstanding court costs, fees, and fines as part of the Client’s representation, regardless of the amount of outstanding court costs, fees, and fines due and regardless of whether or not the information regarding outstanding court costs, fees, and fines immediately available from the Davidson County Criminal Court Clerk was accurate.

All payments associated with services offered through this website shall be made via PayPal.  In the event that a payment made to Attorney or a purchase made through this website is later disputed by a purchaser, a client, or a prospective client, said individual agrees to waive any claim of confidentiality associated with the payment or purchase; releases Attorney from any confidentiality obligations associated with the individual’s purchase; and expressly authorizes Attorney to disclose records of provided services as part of PayPal’s dispute resolution process. In the event that Attorney, a purchaser, a client, or a prospective client seeks to litigate any dispute related to: (1) a purchase, (2) these Terms and Conditions, or (3) any matter arising out of or relating to Attorney’s services—including, but not limited to, any payment obligations concerning such services—the exclusive forum for litigating such dispute shall be the Circuit Court for Davidson County, Tennessee.

These Terms and Conditions may be superseded by private agreement.  In all cases, all fees paid shall be deemed earned upon receipt.
